Abstract:

The International Committee of the Red Cross (ICRC) and various international organizations are navigating a transformative digital landscape, raising critical concerns about maintaining their information security. Essential legal frameworks, in conjunction with technical and organizational strategies, are key to safeguarding information in this digital age.

This lecture will specifically examine the legal principle of inviolability within the context of information security for international organizations. It will cover the applicability of inviolability to data and cyber infrastructure, including data centers and servers. Additionally, the presentation will outline the duties—both negative and positive—of host States that arise from this principle. To illustrate these discussions, references will be made to the privileges and immunities Agreement between the ICRC and Luxembourg, as well as broader practices involving international organizations and states.

The aim of the lecture is to clarify that the Agreement with Luxembourg does not introduce new "digital" privileges and immunities but rather provides interpretations of the existing concept of inviolability.


About the speaker:

Andrea Raab-Gray serves as Legal Counsel at the ICRC’s Delegation for Cyberspace & Global Cyber Hub in Luxembourg. She previously held positions at the Office of the Legal Adviser in the Austrian Ministry of Foreign Affairs and worked as a Legal Adviser for the ICRC in London and Geneva. Andrea played a role in negotiating the Agreement between the ICRC and Luxembourg.

She graduated with honors from the University of Oxford and possesses a law degree from the University of Vienna.
