Restorative Justice for Minors: Different Perspectives. What is the role in Luxembourg?

This is an informative and sharing session dedicated specifically to professionals.

About the Restorative Café

The Restorative Café aims to create an informal informational space to promote discussions among professionals on the issues of restorative justice. Organized by SEJURE, this gathering seeks to strengthen partnerships, share key insights, and delve into specific topics related to restorative justice. It provides an environment conducive to discussions, encouraging collective reflection and the enrichment of practices.

Session Theme

In Belgium, the choice of a protective justice system for minors has supported the development of restorative practices since the late 1950s, long before their legal recognition in 2006. Today, these mechanisms — such as restorative/repair mediation and Group Restorative Consultation (GRC) — are fully integrated into the journey of youths in conflict with the law. Since 2018, these approaches are no longer solely initiated by judicial institutions but can also be directly requested by the parties involved. This session will inform participants about the functioning of the Restorative and Educational Action Services (SARE), accredited in the Walloon-Brussels Federation, relying on the expertise of:

Ms. Géraldine BODART - Director of GACEP Center

Ms. Joanne CESCOTTO - Director of ARPEGE

Their contributions will provide an in-depth look at methodologies supporting youths, highlighting the specific tools and approaches used. These discussions will constitute a valuable opportunity to fuel reflection on the evolution of practices in Luxembourg, which is moving towards the introduction of juvenile criminal law. While restorative justice is already accessible to minors upon their own initiative, it remains underutilized. What approaches can surpass mere judicial responses? What specific added value can it offer? How can these practices be better tailored to meet the needs of young people? How can more effective listening and support spaces be created?
