UNSW Law Journal Issue 47(4) Launch

The University of New South Wales Law Journal is set to launch its Issue 47(4) on 11 December 2024, featuring a keynote address delivered by Hon Justice Julie Ward, the President of the New South Wales Court of Appeal. The theme of this issue is ‘Equity, Conscience and Commercial Morality’. Justice Ward, a trailblazer as the first female solicitor in NSW to be appointed directly to the bench, has a distinguished history of overseeing complex commercial litigation and shaping equitable law with her pivotal judgments.

This thematic issue includes seven articles that delve into the evolution of equitable jurisprudence in Australia, focusing on moral standards in commercial transactions. Topics covered range from a new type of ‘alter ego’ liability to discussions around the Baumgartner joint endeavour principle, equitable disqualification of lawyers, and issues regarding corporate whistleblowers. Furthermore, it addresses the negative impact of corporate governance on ethical practices and proposes solutions for corporations to overcome shareholder prioritization.

Additionally, the issue contains three general articles that investigate advancements outside of equity and commercial law, including proposals for federal legislation benefiting workers with disabilities, experiences of families and legal advocates with alternative dispute resolution in disability discrimination cases, and the application of precedent rules to UN Sales Convention litigation.

The launch will occur at 6pm on Wednesday 11 December 2024 at the Sydney office of King & Wood Mallesons.
